These Terms & Conditions (“Terms”) govern your use of Water Industry Training Specialists at https://www.backflowschool.com/ (the “Site”) and your purchase and use of our training courses and related services. By accessing or using the Site, creating an account, or registering for a course, you agree to be bound by these Terms.

If you do not agree with these Terms, do not use the Site or register for our courses.

1. Who We Are and Eligibility

Water Industry Training Specialists is operated by Water Industry Training Specialists, Inc. (“we,” “us,” or “our”). We provide training courses and related services primarily for adult learners.

By using the Site, you represent that you are at least 18 years old and legally able to enter into these Terms. The Site and our services are not intended for children.

2. Use of the Site

You agree to use the Site and our services only for lawful purposes and in accordance with these Terms. You agree that you will not:

  • Use the Site in any way that violates applicable law or regulation.
  • Attempt to gain unauthorized access to any part of the Site, servers, or systems.
  • Interfere with or disrupt the operation of the Site or the experience of other users.
  • Use automated tools (such as bots or scrapers) to access the Site in a way that is excessive or disruptive.
  • Use the Site to transmit or upload any malicious code, spam, or harmful content.

We may suspend or terminate your access to the Site if we reasonably believe you have violated these Terms or are using the Site in a way that may cause harm.

3. Accounts and Security

To access certain features or enroll in courses, you may need to create an account on Water Industry Training Specialists. You agree to provide accurate and complete information and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. If you suspect any unauthorized use of your account, you must notify us promptly at info@backflowschool.com.

We reserve the right to refuse, suspend, or terminate any account at our discretion, subject to applicable law.

4. Courses, Enrollment, and Access

We offer various training courses, which may include online self-paced content, live online sessions, and/or in-person classes. Course descriptions, schedules, and requirements are provided on the Site or during the registration process.

Your access to a course may be time-limited, for example to specific course dates or a defined access period. We may update or modify course content over time to keep it accurate and useful. We may also change schedules or instructors where needed, with reasonable notice where practical.

We reserve the right to cancel or reschedule a course, particularly if there is low enrollment, instructor availability issues, or other operational reasons. If we cancel a course, our obligations are governed by our Refund & Cancellation Policy.

5. Payments, Pricing, and Refunds

Course prices are listed on the Site and are subject to change at any time before you complete a purchase. The price you see at checkout is the price you agree to pay, along with any applicable taxes or fees.

You authorize us and our payment processors to charge your chosen payment method for the total amount of your purchase. You represent that you are authorized to use the payment method you provide.

All refunds, cancellations, and transfers are governed by our separate Refund & Cancellation Policy, which is incorporated into these Terms by reference. Please review that policy carefully before registering for a course. You can find it on the Site here: Refunds and Returns.

We reserve the right to correct any errors or mistakes in pricing or billing, even if we have already requested or received payment, as permitted by law.

6. Student Conduct

We expect professional and respectful conduct in all courses, whether online or in person. You agree that you will not:

  • Harass, abuse, or threaten instructors, staff, or other students.
  • Disrupt live classes or online sessions.
  • Share course access credentials with others unless expressly permitted (for example, under a group or organizational license).
  • Cheat on quizzes, tests, or assessments or misrepresent your completion status.

We may remove or block access to a course or the Site if we reasonably determine that your behavior violates these Terms or creates a safety or learning issue for others. Where allowed, such removal may occur without a refund.

7. Certificates and Completion

Some courses may provide certificates or proof of completion. We reserve the right to set and enforce completion requirements, such as attendance, passing scores on quizzes or exams, or completion of required modules.

We may decline to issue a certificate if you do not meet the specified requirements, or if we reasonably believe there has been cheating or misrepresentation.

8. Intellectual Property

The Site and all content provided through it, including course materials, videos, quizzes, text, graphics, logos, and other materials (collectively, the “Content”), are owned by Water Industry Training Specialists, Inc. or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable license to access and use the Content solely for your own personal or authorized professional training purposes.

You may not:

  • Copy, reproduce, distribute, or publicly display the Content except as expressly permitted.
  • Share course materials with people who are not enrolled, unless we have given written permission.
  • Resell or otherwise commercially exploit the Content.
  • Remove any copyright, trademark, or other proprietary notices from the Content.

9. No Professional Advice or Guarantees

Our courses and content are provided for educational and informational purposes only. While we aim to provide accurate and practical training, we do not provide legal, engineering, compliance, or other professional advice through the Site unless expressly stated in writing.

You are responsible for determining how our courses apply to your specific situation, and for complying with all applicable laws, codes, and regulations in your jurisdiction. We do not guarantee that completion of a course will result in any particular certification, license, legal compliance, or business outcome unless explicitly stated in writing.

10. Disclaimers

To the fullest extent permitted by law, the Site and all courses and Content are provided “as is” and “as available”, without warranties of any kind, whether express or implied.

We do not warrant that the Site or Content will be uninterrupted, secure, or error-free, or that any defects will be corrected. We do not warrant the accuracy, completeness, or usefulness of any information on the Site, and we disclaim all liability for any reliance placed on such information.

Some jurisdictions, including certain consumer protections under California law, may not allow limitations on implied warranties. In those cases, portions of this section may not apply to you, and you may have additional rights.

11. Limitation of Liability

To the fullest extent permitted by law, in no event will Water Industry Training Specialists, Inc., its owners, employees, instructors, or contractors be liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of income, business, or data, arising out of or in connection with your use of the Site or courses, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claims arising out of or related to the Site, courses, or these Terms will not exceed the amount you paid to us for the specific course or service giving rise to the claim during the twelve (12) months before the event giving rise to the claim.

Some jurisdictions, including California, may not allow certain limitations of liability. In such cases, the above limitations will apply only to the extent permitted by applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Water Industry Training Specialists, Inc., its owners, employees, instructors, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way related to:

Subject to any mandatory consumer protections or jurisdictional rules, you agree that any legal action or proceeding arising out of or related to these Terms will be brought exclusively in the state or federal courts located in Santa Clara County, California, and you consent to the personal jurisdiction of such courts.

Nothing in this section limits any rights you may have under applicable consumer protection laws, including those in California, that provide for different or additional venue or dispute resolution options.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. If we make material changes, we may also provide additional notice, such as posting a notice on the Site or sending you an email.

Your continued use of the Site after we post changes to these Terms means you accept the updated Terms.
